Aurora Cannabis Inc.’s “Winter Wellness Giveaway” Contest
OFFICIAL CONTEST RULES
These are the Official Contest Rules (“Official Contest Rules”) for Aurora Cannabis Inc.’s (“Aurora”) “Winter Wellness Giveaway” Contest (“Contest”).
These Official Contest Rules govern the Contest and all Contest prizes, regardless of whether Aurora awards such prizes. Aurora is the sole sponsor and administrator of this Contest, which is in no way sponsored, endorsed or administered by, or associated with any third parties including Instagram, Facebook, Twitter or Snapchat.
By participating, entrants acknowledge that Instagram bears no responsibility for this promotion and no liability whatsoever in connection with this Contest. Any questions, comments or complaints regarding the Contest must be directed to Aurora and not to Instagram, Facebook, Twitter or Snapchat.
No purchase necessary to enter or win the Contest. By participating, entrants fully and unconditionally agree to comply with and abide by these Official Contest Rules and the decisions of Aurora. Void where prohibited by law.
Entry Period: The Contest is scheduled to begin on or about Monday, February 22, 2021 (the "Start Date") at 9:00 A.M. Eastern Standard Time ("EST") and end on or Monday, March 1, 2021 at 11:59 P.M. EST (the “End Date”). The dates for each giveaway are defined in Schedule A.
Eligibility: The Contest is open to legal residents of Canada (excluding Quebec) who have reached the minimum age for purchasing and consuming cannabis in the province or territory in which they reside. Employees of Aurora, its parents, subsidiaries, affiliates, suppliers and agencies and their immediate family members and persons living in their household are not eligible to enter the Contest. Contest is subject to all applicable federal, provincial and local laws and regulations.
How to Enter: To enter the Contest participants must meet entry requirements, specified in the attached Schedule A – Entry Requirements. There is a limit of one (1) entry per entrant per giveaway method for a total of three (3) valid entries.
Entry Conditions (“Entry Conditions”): Entries must not:
- include defamatory or disparaging words/statements;
- threaten any person, place, business, or group;
- include (as applicable) material that is in any way unlawful, in violation of or contrary to all applicable federal, provincial or municipal laws and regulations; or
- include (as applicable) material that is inappropriate, indecent, profane, obscene, hateful, tortuous, slanderous or libelous.
Aurora reserves the right, in its sole discretion, to (a) revise entries, or request the entrants to revise and resubmit their entries in order to make such entries compliant with these Entry Conditions, (b) remove any submission materials which are deemed inappropriate by Aurora, in its sole discretion; and (c) disqualify any entrant who is found to be acting in violation of any of the Official Contest Rules.
Prize: For each giveaway, one (1) winner will be randomly selected from all eligible entries to each win one (1) prize pack consisting of one Aurora-branded weighted blanket with a cover, a light therapy lamp, and a heated pillow massager (“Prize”). Approximate total value of each prize is $278 CAD. Prize will be distributed within ten (10) days after the winner has been successfully contacted and notified of their prizes and fulfilled the requirements set out herein. Shipped Prizes shall not be insured and Aurora shall not assume any liability for lost, damaged or misdirected Prizes. Prizes are not transferable, assignable, or redeemable for cash. Any applicable Federal, provincial and local tax liabilities are the responsibility of the winners.
Winner Selection: Three (3) winners will be selected in a random drawing on dates defined in Schedule A, from all eligible entries received by the Contest End Date defined in Schedule A. The odds of winning depend on how many eligible entries have been received.
Winner Notification: The potential winner will be notified by Aurora via Instagram Direct Message, Facebook Private Message or email, depending on the winner’s method of Contest entry. Aurora will provide an email address (or other contact information) where the potential winner may make a Prize claim. A winner must respond to such notifications within three (3) business days of receipt and must provide Aurora with full contact details in order to be awarded the Prize.
Skill-Testing Question: The selected entrant will be required to answer an unaided, time-limited mathematical skill-testing question in order to qualify as the winner within three (3) business days from the time that the Winner Notification is sent.
Declaration and Release: The winner may also be required to complete, execute and return an Affidavit of Eligibility and Liability/Publicity Release form, which will be sent to a potential winner in the Winner Notification together with the skill-testing question, if so required. If required, the potential winner must return the original completed and signed Declaration and Release to Aurora within three (3) business days of notification or the Prize will be forfeited and an alternate winner may be randomly selected from all eligible entries received. Aurora shall verify that the potential winner has correctly answered the skill-testing question, and, if required, that the Declaration and Release has been completed satisfactorily. If this/those requirement(s) has/have been met, Aurora shall declare that the potential winner is in fact a winner.
Failure by Winner to Respond: Failure to respond to notifications and/or all required forms within three (3) business days or to comply with any other provision of the Contest may result in the potential winner being disqualified and an alternate winner selected. If a Prize notification or a Prize is returned as undeliverable for any reason, the applicable Prize may be awarded to an alternate winner; however, Aurora does not have the obligation to select an alternate eligible winner.
Refusal by Winner to Accept Prize: Any refusal by a winner to accept a Prize, as awarded and in its entirety, hereby releases and forever discharges Aurora from all obligations to the winner.
General Release: By participating in the Contest, the potential winner agrees to hold Aurora and its respective parent companies, subsidiaries, affiliates, franchisees, successors, assigns, advertising, promotion and public relations agencies, service agencies and independent contractors, and all of those entities' respective directors, officers, employees, representatives and agents from and against any and all liability for any and all costs, injuries, losses or damages of any kind, including, without limitation, death and injury and property loss or damage, due in whole or in part, directly or indirectly, to participation in the Contest, or arising out of participation in any Contest-related activity, or due or related to the receipt, use or misuse of the whole or any part of any Prize or Prize-related activity (including any travel or activity related thereto), or the use by Aurora or its designees of any entry or component thereof. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, EACH PRIZE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, ON THE PART OF ALL RELEASEES. RELEASEES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.
Limitation of Liability: Aurora assumes no liability for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, notifications, responses, replies or any Declaration and Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. Aurora is not liable for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest. Aurora assumes no liability for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Aurora is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this Contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the Contest, or by the acceptance, possession, use of, or failure to receive any Prize.
Interruption or Force Majeure: Aurora assumes no liability in the event that Aurora is prevented from continuing the Contest for any reason beyond the control of Aurora including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this Contest, or any federal, provincial or local government law, order or regulation, or order of any court or jurisdiction.
False or Misleading Information: Any entry, Declaration and Release or any other document required by Aurora for any reason that is incomplete, altered, or contains false or misleading information, shall be invalid and the person who submits such entry or document will be disqualified from the Contest.
Email Accounts and Addresses: An authorized account holder of an e-mail address is the individual assigned to the e-mail address for the domain by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Collection and Use of Personal Information: Personal information will only be collected, used and disclosed by Aurora and its respective designees for the purpose of administering the Contest in accordance with these Official Contest Rules and providing promotional material to the participant in accordance with the Aurora .
Publicity: By accepting a Prize, the winner agrees that Aurora and its respective designees may use the winner’s name, social media username, photographs, videos, likenesses, city of residence, biographical information, Prize information and/or statements about this Contest for advertising and/or publicity purposes in any and all media (now or hereafter known) in perpetuity, without compensation, notification, or permission, unless otherwise prohibited by law.
Governing Law and Jurisdiction: Any dispute arising from this Contest will be determined according to the laws of the Province of Ontario, including the procedural provisions of those laws, without giving effect to any choice of law or conflict of law rules. All entrants agree to consent to the jurisdiction of the courts of Ontario, sitting in Toronto, Ontario, for the determination of any matter or dispute arising under or in respect of Contest.
